Mr G Mcfadden v Whitehead building services: 6019886/2024

EMPLOYMENT TRIBUNALS
Case No 6019886/2024
Mr G McfaddenClaimantWhitehead building servicesRespondent
Employment Judge LeithDate 3 June 2025

JUDGMENT

The claim is struck out.

REASONS

[1]By a letter dated 21 March 2025 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because it has no reasonable prospect of success, because:8.1 On the Claimant’s own case, he did not make a qualifying disclosure so the protected disclosure claims cannot succeed;8.2 On the Claimant’s own case, he was paid for his notice period so no wrongful dismissal claim can succeed; and8.3 On the Claimant’s own case, he lacks the necessary qualifying service to bring a claim of unfair dismissal (per section 108 of the Employment Rights Act 1996). 2. The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out. Approved by:
