[1]The claim of unfair dismissal is struck out. The Claimant does not have the necessary two years’ qualifying service pursuant to Section 108 of the Employment Rights Act 1996 and the claim was not presented within the applicable time limit.[2]Further the claim for race discrimination is struck out under Employment Tribunal Rule 37(1)(a) because it has no reasonable prospect of success. The date that the alleged acts of race discrimination took place was after the Claimant’s employment had ended and the claim was not presented within the applicable time limit.
