EMPLOYMENT TRIBUNALS
Case No 6017833/2025
Mr T IrwinClaimantBar Foose Ltd (In Creditors Voluntary Liquidation)Respondent
Employment Judge PiraniDate 5 March 2026

JUDGMENT

The claim is struck out.

REASONS

[1]By an email sent on 5 March 2026 at 11.33 AM the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because the claim has not been actively pursued.[2]The claimant was asked to respond by 2 pm on 5 March 2026.[3]Prior to that, on 15 January 2026, the tribunal wrote to the claimant asking him to confirm whether he has been paid by the respondent. An answer was required by 22 January 2026. The tribunal also indicated that if the claimant failed to reply, a Legal Officer was minded to refer the case to a judge suggesting that it be struck out because it was not being actively pursued.[4]The claimant has failed to make representations in writing why this should not be done or to request a hearing. The claimant also failed to reply to the 15 January 2026 letter.[5]The claim is therefore struck out.[6]The hearing fixed for 6 March 2026 will not take place. Approved by:
