JUDGMENT
[1]The claimant is seeking to bring a claim for unauthorised deduction of wages.[2]The unauthorised deduction of wages complaint was not presented within the applicable time limit in section 23 of the Employment Rights Act 1996. It was reasonably practicable for the claimant to bring the complaint within the applicable time limit.[3]The complaint is an abuse of process, because the claimant has already brought a (counter)claim for the same unpaid wages in the County Court which was dismissed on 20 October 2024.[4]The Tribunal therefore has no jurisdiction to consider the claim.
