JUDGMENT
[1]Pursuant to Rule 47 Employment Tribunal Procedure Rules 2024 (the 2024 Rules) I decided to proceed with this hearing in the absence of the Claimant having considered the reasons for her absence and taking into account the information available to me.[2]The Respondent’s application to strike out the claims in this case which are complaints of unfair dismissal, sex, race, disability, and age discrimination SUCCEEDS.[3]Under Rule 38 of the 2024 Rules I strike out all the claims on three grounds:- i) That the Claimant has not complied with orders of the Tribunal made on 11 September 2025 and 17 October 2025. ii) That the claim of constructive unfair dismissal has been made out of time by reference to section 111 Employment Rights Act 1996. I find Case Number: 6017329/2025 that it was reasonably practicable to bring this claim within the relevant time period and I decline to extend time. iii) That the complaints of discrimination have been made outside the time limits in section 123 Equality Act 2010 and I do not consider that it is just and equitable to extend the period of the time limit. iv) A Tribunal therefore has no jurisdiction to hear these claims out of time.[4]All the claims in this case are therefore struck out and DISMISSED.
