JUDGMENT
[1]The Claimant’s claims for unlawful deduction of wages and accrued holiday pay against the Respondent succeed.[2]The Claimant worked for the Respondent from 6 February 2023 to 30 July 2024.[3]Although damages are calculated on a net basis, since the Claimant will be liable for tax on the elements relating to pay, the gross figure is used in the calculation.[4]The Respondent is therefore ordered to pay the Claimant following sums:4.1 £2227.50 unpaid accrued holiday pay (16.5 days x £135.00)4.2 £2600.00 in respect of unpaid wages for June 20244.3 £300 in respect of unpaid overtime in June 2024.[5]The Respondent is ordered to pay the Claimant the total sum of £5,127.50.
