JUDGMENT
[1]The respondent does not contest the claimant's claim for a redundancy payment.[2]The claimant's claim for a redundancy payment succeeds.[3]The respondent shall pay to the claimant the sum of £2,813.08, being the redundancy payment due to the claimant under section 135 of the Employment Rights Act 1996.REASONS
[4]The claimant presented a claim to the Employment Tribunal on 22 October 2024 seeking a redundancy payment of £2,813.08 from the respondent.[5]The respondent submitted a response on 19 November 2024 stating that it did not contest the claim but indicated that it was unable to pay the redundancy payment as the company is insolvent and was expected to enter administration at the end of November 2024.[6]The respondent confirmed its agreement with the details of the claimant's employment provided in the claim form.[7]The respondent has admitted that the claimant is entitled to a redundancy payment but has stated that it is unable to pay due to insolvency.[8]In these circumstances, the Tribunal is satisfied that the claimant is entitled to a redundancy payment of £2,813.08 as claimed.
