The response of the first respondent is struck out.REASONS
[1]By an order dated 1 September 2025, in light of the first respondent’s nonattendance at that hearing, the Tribunal indicated that consideration would be given to whether it was appropriate to strike-out the first respondent’s response at a further hearing on 26 September 2025 because it has not been actively pursued.[2]The first respondent has failed to make representations in writing why this should not be done and did not appear at the hearing today. The first respondent’s response is therefore struck out.[3]The first respondent will be entitled to notice of any hearings and decisions of the Tribunal but will only be entitled to participate in any hearing to the extent permitted by the Tribunal.
