JUDGMENT

[1]The complaint of unfair dismissal is not well-founded. The claimant was not unfairly dismissed by the respondent and the claim fails.[2]The complaint of breach of contract in relation to notice pay is not wellfounded and fails.[3]The complaint of failure to provide written particulars of employment contrary to section 1 ERA 1996 is not well-founded and fails.[4]The complaint of failure to provide written reasons for dismissal contrary to sections 92 ERA 1996 succeeds, as no written reasons were provided to the claimant by the respondent. The respondent is to pay the claimant the equivalent of two weeks’ pay which is £796.16 (net) (£398.08 x 2, based on 40 hour week at £12.44 per hour; tax rate 20%).
