JUDGMENT
[1]The respondent unfairly dismissed the claimant contrary to section 98 Employment Rights Act.[2]The respondent shall pay the claimant a basic award of £2100.[3]The respondent shall pay the claimant a compensatory award of £835.24.[4]The award for unfair dismissal is increased by 25% under S207A Tulra 1992 making a basic award of £2625 and a compensatory award of £1044.05.[5]Accordingly, the total award for unfair dismissal is £3669.05.[6]The respondent wrongfully dismissed the claimant.[7]The respondent shall pay the claimant the sum of £2784.29 as a statutory notice payment. This sum is calculated net of statutory deductions.[8]The respondent shall pay the claimant the sum of £9280.96 as a contractual notice payment. This sum is calculated net of statutory deductions.[9]The respondent made unauthorised deductions from the claimant’s wages contrary to section 13 Employment Rights Act 1996 for the period 1 to 10 October 2024.[10]The respondent shall pay the claimant the sum of £1785.71 in respect of unlawful deductions from wages. This sum is calculated gross of statutory deductions.[11]The respondent failed to pay the claimant in respect of annual leave contrary to regulation 14 Working Time Regulations 1998.[12]The respondent shall pay the claimant £17500 under regulation 14 Working Time Regulations. This sum is calculated gross of statutory deductions. This sum is made up of the followinga. 20 days for 2021 being £3571.43b. 28 days for 2022 being £5000c. 28 days for 2023 being £5000d. 22 days for 2024 being £3928.57[13]It is just and equitable to increase the award under this judgment by the higher amount under s38 Employment Act 2002, being £2800[14]Accordingly, the total payable by the respondent to the claimant under this judgment is £37,820.01 Approved by:
