Mr S Taylor v ISS Facility Services Ltd: 6014305/2024
JUDGMENT
The claim is struck out.REASONS
[1]By a letter dated 24 February 2025 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because• He has not complied with the Orders of the Tribunal dated 18 October 2024• it has not been actively pursued[2]There has been no response to the Tribunal's letter to the claimant warning him that his case might be struck out. His non-compliance with Tribunal orders and failure to communicate with the respondent and the Tribunal threaten the viability of the planned final hearing in June. It appears that he has abandoned his claim. In the circumstances, it would be in accordance with the overriding objective to strike out the claim on the basis that the claimant has not complied with Tribunal orders and that the claim is not being actively pursued; and I exercise my discretion to strike it out.[3]The hearing fixed for 17 and 18 June 2025 will not take place.
