The claim is struck out.REASONS
[1]By a letter dated 9 July 2025 the Tribunal gave the claimant an opportunity to make representations or to request a hearing as to why this claim should not be struck out because the claimant had brought two very similar claims which was an abuse of process. The claimant was also invited to withdraw this claim.[2]The claimant replied to the Tribunal on 11 July 2025 stating that she had only made one claim, but two claim numbers were generated and responded to. She did not as such withdraw this claim. She said the second case number had been generated because of an “administrative error”.[3]The Tribunal’s records show that claim 6013455/2024 was submitted on 1 October 2024 and this claim (claim number 6013727/2024) was submitted on 2 October 2024. They are not entirely identical (see for example the contents of their sections 8.2) but the differences are immaterial. It is clear that the claimant did, therefore, submit two claims but her response of 11 July 2025 also makes clear that she did not intend to do so.[4]Employment Judge Evans therefore strikes out claim 6013727/2024 pursuant to Rule 38 of the Rules of Procedure as to permit it to continue would in these circumstances be an abuse of process. Claim 6013455/2024 continues. Approved by:
