JUDGMENT

Souza; and Dr Reha Shrestha, Dr A De Souza, Dr D De Souza, in person[1]The parties have agreed as follows:a. Wages: The respondent made an unauthorised deduction from the claimant's wages in the period 1-30 September 2024. The respondent shall pay the claimant the gross sum of £1380.11 deducted from pay. In addition, the respondent shall pay the claimant the net sum of £236.92 to compensate for the financial loss (in the form of daily interest over a six month period based on a £1300 overdraft) which is attributable to this unauthorised deduction.b. Breach of contract: The respondent shall pay the claimant the net sum of £88.82 as damages in relation to the cost of replacing a birth certificate (£38.50) and a change of name certificate (£50.32).c. The respondent therefore shall pay the claimant a gross sum of £1787.29 by 24 March 2025. This figure is made up of the gross sum of £1380.11 (for unauthorised deduction in wages) and the gross sum of £407.18 (which is the grossed-up figure of the net sum of £236.92 plus £88.82).[2]Upon the parties agreeing terms of settlement, and by consent, all proceedings in this matter are stayed until 4pm on 31 March 2025 at which time without further order they shall be dismissed upon withdrawal by the claimant unless Case Number: 6013286/2024 before that time either party has notified the Tribunal that it does not wish this judgment to take effect.
