[1]The Claimant's complaint of arrears of pay due in respect of a November 2024 commission payment of £892.19 (relating to commission earned in October 2024) does not succeed and is dismissed.[2]The Claimant's other complaints succeed and the Tribunal declares that the Claimant's commission earnings should have been included in the calculation of her statutory redundancy payment and payment in lieu of notice.[3]The Secretary of State for Business and Trade is liable to the Claimant for:3.1 additional statutory redundancy pay in the sum of £6,056.29; and3.2 additional notice pay in the sum of £3,389.54.[4]The total sum payable to the Claimant by the Secretary of State for Business and Trade from the National Insurance Fund is therefore £9,445.83.
