JUDGMENT

UNDER RULE 39 The claim is dismissed for non-compliance with an Unless Order.

REASONS

[1]Following a Hearing on 24 September 2025, Judge Wilson made an Unless Order requiring compliance by 10 November 2025. The Order was not however sent to the parties until 11 November 2025.[2]The same period of time (7 weeks) has now elapsed since the Unless Order was sent to the claimant and there has been no compliance.[3]The claimant was warned that his claim was at risk of being struck out under Rule 38(1) (c) and (d). He failed to attend a preliminary hearing. He appears to not be engaging with the respondent, and the Tribunal has not heard from him since the issuing of the ET1 despite the order of Employment Judge Heath requesting further information as set out in the letter dated 9 January 2025. The claimant has also therefore not complied with an order of EJ Heath.[4]The claim is therefore dismissed under Rule 39.[5]The hearing on 12-15 May 2026 will not take place. Approved by:
