JUDGMENT

[1]The respondent made unlawful deductions from the claimant’s wages in respect of the period 11 November to 2 December 2024 contrary to section 13 Employment Rights Act 1996.[2]The respondent shall pay the sum of £817.96 in respect of unlawful deductions from wages. That sum is awarded gross of statutory deductions.[3]The respondent failed to pay the claimant her annual leave contrary to Reg 16 Working Time Regulations 1996.[4]The respondent shall pay the claimant the sum of £246.19 in respect of holiday pay. This sum is awarded gross of statutory deductions.[5]The respondent wrongfully dismissed the claimant.[6]The respondent shall pay the claimant the sum of £397.19 in respect of unpaid notice. This sum is awarded net of statutory deductions.[7]At the time the proceedings were begun the respondent was in breach of its duty to the claimant under section 1 Employment Rights Act to give a statement of employment particulars.[8]It is just and equitable to increase the award to the claimant by the higher amount under s38 Employment Act 2002 being £1830.40.[9]Accordingly the total to be paid to the respondent to the claimant under this judgment is £3291.74.
