[1]The Claimant’s claim of unfair dismissal contrary to s.94(1) Employment Rights Act 1996) (‘ERA 1996’) has no reasonable prospect of success and is struck out.REASONS
[2]The Claimant is a serving police constable. The Tribunal does not have jurisdiction to consider her complaint for ordinary unfair dismissal for two reasons. Firstly, because by virtue of s.200 ERA 1996 the provisions of Part X of the ERA 1996 do not apply to employment under a contract of employment in police service and secondly because she has not in fact been dismissed.
