J Shepherd v Secretary of State for Justice: 6010202/2024

EMPLOYMENT TRIBUNALS
Case No 6010202/2024
Jonathan ShepherdClaimantSecretary of State for JusticeRespondent
Employment Judge AyreDate 21 July 2026

JUDGMENT

The claim is struck out.

REASONS

[1]The Tribunal wrote to the claimant on 16 September 2025 warning them that the Tribunal was considering striking out the claim. This was because it appeared to the Tribunal, applying Rule 38 of the Employment Tribunal Procedure Rules 2024, that  the claimant has repeatedly failed to comply with the order of Judge Robertson dated 25 June 2025 and the strike out warning of the Tribunal dated 16 September 2025.  The responses the claimant has provided do not address the issue. The claimant has failed to comply with Tribunal Orders, failed to actively pursue his case and a fair hearing of the claim is no longer possible.[2]I am satisfied that the grounds for striking out the claim under Rule 38 apply, and that it would be in accordance with the overriding objective in Rule 3 to strike out the claim.[3]The claim is therefore struck out.
