JUDGMENT
The Judgment of the Employment Tribunal is as follows:[1]The claimant was an employee of the respondent at the relevant time.[2]The claimant made protected disclosures and was subjected to detriments under section 47B Employment Rights Act 1996.[3]The claimant was unfairly dismissed for making protected disclosures under section 103A Employment Rights Act 1996.[4]The claimant was disabled within the meaning of section 6 of the Equality Act 2010 at all material times.[5]The respondent failed to make reasonable adjustments under sections 20 and 21 Equality Act 2010[6]The claimant was subjected to victimisation under section 27 of the Equality Act.[7]The claim for sex discrimination is dismissed since the respondent was not found to be liable for the actions of the external contractor who made the discriminatory comments.[8]The claim of discrimination arising from disability under section 15 is not made out on the facts and is dismissed.[9]The respondent is ordered to pay the claimant the sum of £70,824, which comprises past financial loss of £43,559 (including interest) and an award of £27,265 for injury to feelings (including interest).[10]The Recoupment Regulations do not apply.
