[1]The claim is struck out under Employment Tribunal Rules 38(1)(c) and (d) because the Claimant is in breach of a Tribunal Order and has not actively pursued the case.REASONS
[2]A strike out warning was issued on 29 April 2025 by EJ Fredericks-Bowyer. The Claimant did not respond to that strike out warning and has still not complied with the Order of Employment Judge Burge dated 9 January 2025 or actively pursued the claim. It is therefore in accordance with the overriding objective for the claim to be struck out.[3]The preliminary hearing listed for 23 September 2025 and the final hearing listed for 14 – 16 September 2026 will not take place.
