JUDGMENT

[1]The claimant’s claim for unlawful deduction of wages succeeds. The respondent is ordered to pay the claimant the sum of £7,169.48 (net). This sum is net as it is the difference between what the claimant should have received after deductions for tax and NICs and what she did receive between January 2024 and June 2024.[2]The claimant’s claim for holiday pay succeeds. The respondent is ordered to pay the claimant the sum of £1,716.92 (gross) in respect of 12 days’ untaken accrued annual leave.[3]The respondent did not provide the claimant with a written statement of particulars of employment. In accordance with section 38 Employment Act 2002 the respondent is ordered to pay the claimant the sum of £1,420.77 (gross), equating to two weeks’ pay.
