JUDGMENT
The judgment of the Tribunal is as follows: Unfair Dismissal[1]The complaint of constructive unfair dismissal is well-founded.[2]The First Respondent shall pay the Claimant compensation by way of a basic award of £7,350. No compensatory award was made. Wages[3]The complaints of unauthorised deductions from wages are well-founded.[4]The respondent made an unauthorised deduction from the claimant's wages, in the period from 1 January 2025 to 7 March 2025, in the sum of £16,725.00.[5]The First Respondent failed to make employee’s pension contributions in the sum of £11,250.00, that sum having been withheld from wages as salary sacrifice.[6]The first Respondent failed to pay a contractual bonus of £8,786.03 on 8th October 2024.[7]The Claimant having received payment from the Insolvency Service in the gross sum of £5,752.00, the First Respondent will therefore pay the Claimant the gross sum of £38,359.03. Breach of contract[8]The First Respondent failed to make employer’s pension contributions in the sum of £16,875.00. The First Respondent will pay the Claimant £16,875.00.[9]The First Respondent failed to reimburse the Claimant for his reasonable business expenses. The First Respondent will pay the Claimant £801.67. Notice Pay[10]The complaint of breach of contract in relation to notice pay is dismissed upon withdrawal.
