JUDGMENT
[1]Following a Transfer of an Undertaking, namely The Wheatsheaf Hotel, 37 Church Street, Littleborough, Rochdale, pursuant to Regulation 4 Transfer of Undertakings Regulations 2006, “TUPE”, in or around 25 June 2004, the claimant was automatically unfairly dismissed pursuant to Regulation 4(9) and Regulation 7 TUPE by the second respondent.[2]I award the claimant a basic award of £2,002 (£572 x 3.5)[3]I award a loss of statutory rights of £500.[4]I award notice pay of £3,432 (£572x 6)[5]I award a compensatory award of £1,977 for the period 6 August -6 September 2024. (£572 x 4-£311) plus £2,080 for the period 6 September 2004 to 17 November 2025 at £30 weekly =£4,057.[6]The grand total payable by the 2nd respondent to the claimant within 14 days of the date of this Judgment is £9,991. 7.The Recoupment Regulations do not apply.
