JUDGMENT
[1]The complaint of direct race discrimination is not well-founded and is dismissed.[2]The complaint of harassment related to race is not well-founded and is dismissed.[3]The claimant’s equal pay claim fails and is dismissed. Whilst the claimant and her comparator were engaged in ‘like work’ within the meaning of section 65(1)(a) Equality Act 2010, the respondent has established a material factor defence within the meaning of section 69 of the Act. Consequently, the sex equality clause in the contract has no effect in relation to the difference in pay.[4]The complaint of constructive dismissal as an act of discrimination also fails and is dismissed.
