UPON reading the papers AND UPON hearing argument from the claimant in person and Mr Moretto for the respondent The Judgment of the Tribunal is:[1]The claims are dismissed pursuant to Rule 28 on the grounds that Tribunal has no jurisdiction to consider the claim, the claimant having failed to comply with the requirement in section 18A of the Employment Tribunals Act 1996 before presenting the claim in respect of all claims presented in the claim form.[2]Further or alternatively, the claims are struck out pursuant to Rule 38 on the grounds that the Tribunal has no jurisdiction to hear them because of the claimant’s failure to comply with section 18A ETA 1996 as set out above.
