JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The first respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £3890.66 (£1557.33 – balance of March 2024 salary and £2333.33 – April 2024 – one month’s salary).[2]The claimant was dismissed in breach of contract in respect of notice and the first respondent is ordered to pay damages to the claimant in the sum of £2,692.30 (Monthly gross salary £2333.33 x 12 = £27,999.97 per annum divided by 52 weeks = £538.46 per week x 5 weeks statutory notice pay)[3]The claimant was dismissed by the first respondent by reason of redundancy and is entitled to a redundancy payment of £4035.45.[4]The complaint in respect of holiday pay is dismissed upon withdrawal by the claimant.[5]The total amount awarded and to be paid by the first respondent to the claimant is £10,618.41.[6]The claim against The Insolvency Service (Secretary of State) as second respondent is dismissed 6. The hearing listed on 1st May 2025 is cancelled.
