Ms C Ansumana v Guy’s and St Thomas’ NHS Foundation Trust: 6006144/2024
JUDGMENT
The following complaints of detriments done on the grounds that the Claimant had made one or more protected disclosures are dismissed following a withdrawal of them by the Claimant:a. From 2021 and continuously thereafter, Respondent personnel laughed out loud when the Claimant read her Bible during a break, and made derogatory comments such as “Do you think you will see Jesus, are you praying?”;b. At the Claimant’s disciplinary hearing (on one of 7 December 2023, 17 January 2024 and 18 January 2024), staff of the Respondent laughed at the Claimant and/or made derogatory comments about the Claimant reading her Bible or praying during her break in front of the members of the management team, and no action was taken to stop or criticise those comments; andc. On many occasions in 2022 and 2023, and on every occasion that the Claimant was in the staffroom alone during break times, members of the Respondent’s staff entered the room, and when hey observed that the Claimant was there, ‘kissed their teeth’, before they exited the staffroom, slamming the door. The Claimant’s other complaints, including other complaints of detriments done on the grounds that she had made protected disclosures, are unaffected by this judgment.
