JUDGMENT

[1]The Claimant’s complaints under the Employment Rights Act 1996 of automatically unfair dismissal by reason of having made protected disclosures (s. 103A) and of detriment done on the ground that he had made protected disclosures (s. 47B) are dismissed on withdrawal.[2]The Claimant's application to amend his claim number 6006052/2024 (the “Second Claim”) to add the following PCPs to his complaint of failure to make reasonable adjustments is refused:a. a requirement to perform the duties of the role;b. a requirement to participate verbally in meetings;c. the application of standard performance management processes;d. a practice of failing to implement occupational health and/or medical recommendations within a reasonable time.[3]The Claimant's applications to amend his claim number 6038777/2025 (the “Third Claim”) are refused, namely:a. to add a complaint that the refusal of his requests for reasonable adjustments (in particular on 6 March 2025 and at the meetings of 21 May and 5 June PHCM Order 1 of 2 September 2023 Case Numbers: 6006052/2024 and 6038777/2025 2025) was unfavourable treatment because of something arising in consequence of his disability, contrary to s. 15 of the Equality Act 2010; andb. to add a complaint of victimisation contrary to s. 27 of the Equality Act 2010, that the Respondent failed to deal with his grievance because he had done a protected act.
