The claim is struck out.REASONS
[1]By a letter dated 29 July 2025 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because• it has not been actively pursued.[2]Judge Johnson acknowledges the respondent solicitor's recent correspondence and their observation that Judge Buzzard's strike out warning was not sent out by the Tribunal until after the revised dates for compliance (upon which the warning had been given), had passed. However, it is noted that the suggested revised time limits for compliance with the order of 19 August 2025 and proposed by the respondent in their letter dated 31 July 2025 (and which the claimant was copied into), has not been complied with either. The claimant has simply failed to make any attempt to progress their claim.[3]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing.
