JUDGMENT
[1]The Claimant’s claim for compensation for untaken ‘rest days’ is struck out under Rule 38(1)(a) of the Employment Tribunal Rules 2024 because it has no reasonable prospect of success.[2]The Claimant’s claim in respect of holiday pay under the Working Time Regulations 1998 is well-founded. The Respondent failed to pay the Claimant’s holiday entitlement of 24 days. The Respondent shall pay the Claimant the gross sum of £4,716.17 and account to HMRC for any tax and National Insurance due on this sum. Approved by:
