Case No 6004221/2024
Ms F J RilwanClaimantEleanor Care and Nursing PARTIAL STRIKE OUT The claimant’s complaint of unfair dismissal is struck out because she does not have the required 2 years’ service to advance that complaint under s108 Employment Rights Act 1996 .Respondent
Employment Judge Fredericks-BowyerDate 16 September 2024

REASONS

[1]The claimant does not have two years’ service employed by the respondent. She brings a complaint of unfair dismissal.[2]By letter dated 1 August 2024, the claimant was given the opportunity to show reason why her unfair dismissal complaint should be allowed to continue despite not having that length of service.[3]The claimant’s reply does not set out any reasons which are set out in the Employment Rights Act 1996 allowing a claim to be brought without 2 years’ service; the claimant asserts that she was dismissed and sets out that the decision was unfair. That complaint is struck out.[4]The claimant’s complaint of race discrimination is not affected by this judgment.
