JUDGMENT
[1]The respondent has made an unauthorised deduction from the Claimant’s wages and is ordered to pay him the gross sum of £603.08 in respect of holiday pay (calculated as 5.6 weeks x 8/52 of the year x £14 per hour x 50 weekly hours). The claimant shall be responsible for the payment of any Tax or National Insurance.[2]The Claimant was dismissed in breach of contract in respect of notice and the Respondent is ordered to pay damages to her in the gross sum of £1,843.25 (calculated as (4 weeks x 35 contractual hours x £14 per hour) - £116.75 (for the payment received during the week of notice given)). The claimant shall be responsible for the payment of any Tax or National Insurance.[3]The respondent has breached the claimant’s contract in respect of contractual sick pay and is ordered to pay damages to him in the gross sum of £471.25 (calculated as 1.2 weeks x £14 per hour x 35 contractual hours). The claimant shall be responsible for the payment of any Tax or National Insurance.[4]The total sum that the respondent is ordered to pay the claimant is the gross sum of £2917.58.[5]Recoupment does not apply.
