JUDGMENT

Having heard representations from both parties at the resumed preliminary hearing on 28 November 2025 (adjourned part heard on 22 September 2025), I made the following judgment:(1) The complaint of unfair dismissal is struck out because the claimant remains in employment and consequently this complaint has no reasonable prospects of success applying Rule 38 of the Employment Tribunal Procedure Rules 2024.

(2) The complaints brought under the Equality Act 2010 are unaffected by this judgment and will proceed to be determined at the final hearing listed to take place over 5 days from 16 to 20 November 2026.

(3) For the avoidance of doubt the Tribunal does not have jurisdiction to hear any of the other potential claims identified within the claim form and attached documents and they will not be considered within these proceedings. Approved by:
