JUDGMENT
On hearing for the Claimant in person and no attendance by the Respondent:[1]The Claimant’s claim for breach of contract in failing to pay wages for annual leave taken, succeeds and was uncontested.[2]In accordance with the contract of employment, the Claimant is entitled to £1,155 being 17 days annual leave for a normal working day of 7.5 hours per day at the rate of pay of £14 per hour, less 45 hours of pay already paid. The Calculation, as discussed and agreed with the Claimant, was:a. 17 days taken leave x 7.5 hours per working day = 127.5 hoursb. 127.5 hours less 45 hours already paid = 82.5 hoursc. 82.5 hours x £14 per hour = £1,155.00 (gross)[3]The Respondent is ordered to pay to the Claimant £1,155 less any usual deductions at source. If the gross figure is paid to the Claimant, the Claimant has agreed that he will account to HMRC for any tax that may be due.
