JUDGMENT
[1]The Claimant’s claims of unfair dismissal, a right to a redundancy payment, and breach of contract are all dismissed.REASONS
[1]At the public Full Merits Hearing listed for today's date the Claimant attended by videophone but there was no appearance by nor ET3 filed by the Respondent. I decided they could take no part in the proceedings.[2]The Claimant’s employment commenced on the 10 September 2023 and ended 30 April 2024. Thus, as at the effective date of termination of her employment, she had not secured 2 years continuous service. Therefore, she could not succeed in her claims for unfair dismissal and for declaration of a right to a redundancy payment which claims were therefore dismissed. 1 of 2 Case Number: 6002827/2024[3]I caused there to be undertaken a company search and discovered that the Respondents are a company in compulsory liquidation and therefore cannot take part in these proceedings unless leave of the Court were granted or consent from the Liquidators obtained. Neither leave has been granted nor consent obtained and therefore the breach of contract claim must fail and is dismissed as the Tribunal does not have jurisdiction to hear such claim against a company in liquidation without leave or consent of the liquidators.
