The complaint of unfair dismissal is struck out. The claimant’s unlawful deduction from wages complaint continues to a hearing unless otherwise resolved.REASONS
[1]The claimant’s presented a claim form ticking the unfair dismissal box. He does not have two years’ service. He has since confirmed that claim was a mistake. He seeks only unpaid wages in the sum of £4320.[2]The ET3 form is due from the respondent on by no later than 29 August 2024. If a response form is not received by the Tribunal by that date a Rule 21 Judgment for the sum may be given. Otherwise I have directed a two hour hearing by video on the first available date to determine that wages claim.
