JUDGMENT

[1]The claim was presented in the London South Employment Tribunal on 26 January 2025. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 22 of the Rules of Procedure.[2]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £8,154.36. This excludes any wages which were due to be paid to the claimant before 26 January 2023, because of the limitation provision in section 23(4A) of the Employment Rights Act 1996. It includes tips payable to the claimant by the respondent in the sum of £198.[3]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £2,937.60. This is calculated based on 10.2 weeks accrued but untaken annual leave, at the rate of £288 per week (£9 per hour, 8 hours per day, four days per week). Approved by:
