The Claimant's claim is struck out.REASONS
[1]A preliminary hearing for case management by telephone was listed to take place on 21 November 2025. The Claimant did not attend.[2]Shortly before the hearing, the Respondent sent a chasing email to the Claimant in connection with the case management agenda. The Claimant replied to that in the following terms: In response to your email I would like to request that this case be closed. For my own safety and wellbeing I have left the UK due to verbal threats on my safety. As much as I would have loved to have justice for the poor mistreatment received from my previous employer, my sanity and safety is far more valuable.[3]I caused the Tribunal administration to send an email to the Claimant seeking to confirm if she was withdrawing her claims, but no reply was received. I also asked a member of staff to call her on the phone number in her claim form, but no contact was made.[4]Whilst it appeared the Claimant wished to withdraw her claim, she had not written to the Tribunal. Her message was sent to the Respondent's solicitor.[5]By a case management order of 21 November 2025, the Claimant was warned I was considering striking out her claim because it was no longer being actively PHCM Order (NEW August 2020) 1 of 2 August 2020 Case Number: 6002668/2025 pursued. She was given until 28 November 2025 to write to the Tribunal if she wished to oppose strike out, or alternatively to confirm the withdrawal of her claim. The Claimant did not respond to this order.[6]The Claimant is not actively pursuing her claim and I strike this out under rule 38(1)(d).
