The claim is struck out.

REASONS

[1]The claim was listed for a final hearing on 27 September 2024. Neither party attended. The judge on that occasion wrote to the parties seeking an explanation for their non-attendance.[2]There is no record that either party replied.[3]There is no record that either party has since contacted the tribunal to enquire about progress of the claim.[4]The facts before me show this is a claim that has not been actively pursued and is breach of a tribunal order. That may or may not be because the respondent is showing on the public register as being in creditors’ voluntary liquidation.[5]In view of the extreme delay without any contact from the claimant I do not consider it requires a strike-out warning. In these circumstances, it is proportionate to move directly to strike out.[6]The claim is therefore struck out under rule 38 of the Employment Tribunal Procedure Rules 2024. Approved by:
