JUDGMENT
[1]The claimant’s claim for unlawful deduction from wages under section 13 Employment Rights Act 1996 is well founded and the respondent is ordered to pay the claimant the sum of £763.89 (gross).[2]The claimant’s claim for holiday pay is well founded and the respondent is ordered to pay the claimant the sum of £423.08 (gross).[3]The respondent did not provide the claimant with a written statement of particulars of employment. In accordance with section 38 Employment Act 2002 the respondent is ordered to pay the claimant the sum of £2,115.38, which equates to 2 weeks’ pay.[4]The respondent dismissed the claimant without notice but had paid the claimant a sum in lieu of notice before this hearing, so no further compensation is due in respect of notice pay.
