The Respondent’s application for the claim to be struck out for non-compliance with Tribunal orders or because it has not been actively pursued is refused.REASONS
I was not satisfied that the Claimant had failed actively to pursue her claim. Following her non-attendance at a previous preliminary hearing, she had communicated with the Tribunal and provided some evidence and explanation. She confirmed that she wishes to pursue her claim. The Claimant had failed to comply with Tribunal orders. However, part of the explanation was a period of poor health. In any event, a fair hearing remains possible and striking out the claim would be disproportionate.
