JUDGMENT

[1]The title of the Respondent is amended to Redpath Deilmann UK Limited[2]The claim is dismissed.

REASONS

[1]The Claimant failed to attend this hearing at 2pm, and in the course of an adjournment did not answer his mobile telephone nor respond to a voice mail message before the case resumed at 2.30pm.[2]The notice of hearing was sent to the email address given on the ET1 on 16th July 2024.[3]I am informed that the Respondent’s solicitors received confirmation from the Clamant on 29th October 2024 that that was his correct email address for correspondence.[4]I am also informed that the Claimant has failed to reply to communications from the Respondent in attempted preparation for this hearing on 31st October , 4th November, 7th November and 11th November 2024. Case: 6002046/2024[5]I am satisfied, therefore, that the Claimant is fully aware of this listed hearing.[6]Even though this is only the first preliminary hearing the history of not actively pursuing the claim, together with the fact that, certainly as currently pleaded, this largely unparticularised complaint of automatically unfair dismissal by an employee with less that 2 years’ continuous service does not obviously have a reasonable prospect of success, makes it proportionate to dismiss at this stage. .
