JUDGMENT
[1]The parties agree that the Claimant’s employment transferred from the First Respondent to the Second Respondent pursuant to the Transfer of Undertakings (Protection of Employment) Regulations 2006. Liability for matters that arose prior to the transfer transferred to the Second Respondent. The First Respondent is removed as a Respondent to these proceedings.[2]The Claimant’s claim for constructive dismissal had not crystalised as at the date that proceedings were issued. Accordingly, the requirements of s.111 Employment Rights Act 1996 are not met and the Tribunal does not have jurisdiction to hear the Claim.[3]The Claimant indicated that he may wish to pursue claims in another forum.
