The claim is struck out.REASONS
[1]By a letter dated 27 June 2025 the Tribunal gave the Claimant an opportunity to make representations or to request a hearing at which to do so, as to why the claim should not be struck out. It appeared a fair hearing was no longer possible because it had no reasonable prospect of success.[2]The Claimant failed to make any sufficient representations why this should not be done or to request a hearing. Further, in response to the preliminary case management hearing listing, the Claimant continued to assert that he was bringing a breach of contract claim when it has been explained to him that he cannot as a current employee of the Respondent. A fair hearing is not possible. The claim is therefore struck out.[3]The hearing fixed for 15 August 2025 will not take place. Approved by:
