[1]In a case management order dated 13 December 2023 Employment Judge Ayre warned the Claimant that his claims might be struck out because:a. He had not worked for the Respondent for two years and therefore could not bring his unfair dismissal claim under the Employment Rights Act 1996; andb. The disability on which he wished to rely in his disability discrimination complaint was specifically excluded from the definition of disability in the Equality Act 2010.[2]The Claimant was given seven days to object or request a hearing. He did not do so.[3]It appears to me that the Tribunal has no jurisdiction to deal with these claims and that they have no reasonable prospect of success.
