Mr C Blewett v The Co-Operative Group Ltd: 6001387/2024
JUDGMENT
[1]The following complaints succeed, and it is just and equitable to extend the time limit in respect of them:a. Disability-related harassment (sending the Claimant home on 27 March 2023 and requiring him to take sickness absence);b. Failure to make reasonable adjustments, namely placing the Claimant on paid suspension pending seeking medical advice, and then restricting his duties to counterbalance and reducing his hours to 22.5 hours a week.[2]The complaints of direct disability discrimination are dismissed.[3]The complaint of unauthorised deductions from wages is dismissed on the basis that it was presented out of time and the Tribunal does not have jurisdiction to consider it.[4]The Claimant is awarded compensation as follows:a. For financial losses: £2,737.14 plus interest of £550.73;b. For injury to feelings: £10,000 plus interest of £2,354. Case Number: 6001387/2024[5]The Respondent must pay the Claimant the total amount of £15,641.87. Approved by:
