J Banach v Karpaty Leeds Ltd: 6001291/2023
JUDGMENT
AND WRITTEN REASONS The claimant having failed to attend today’s hearing; the claimant having failed to respond to the tribunal’s letter of 25 August 2023, asking her to confirm what language she requires an interpreter to speak (the claimant having indicated in her claim form that she requires a translator, without giving any indication of what language she speaks); the tribunal clerk having tried to call the claimant on the mobile telephone number provided in the claim form, and receiving a standard message saying it was not possible to connect her call; and Mr Muhammad having confirmed that the respondent has had no contact from the claimant since she left work in March 2023: THE JUDGMENT OF THE TRIBUNAL IS THAT (1) The claims are dismissed pursuant to Rule 47 Employment Tribunal Rules of Procedure 2013, because the claimant has not attended the hearing, it was not possible to proceed with the hearing in her absence, and all practicable enquiries were made to find out why the claimant did not attend, if the claimant’s failure to attend, that were practicable in the circumstances.
