JUDGMENT
The claimant having failed to attend the hearing and the Judge having considered all relevant documentation and heard oral submissions from Mr McHugh for the respondent, the decision of the tribunal is that:(1) the claimant has failed to demonstrate substantial compliance with the Unless Orders made by Employment Judge Brain on 2 January 2024 and subject to(2) below, the claim is dismissed (Rule 38(1) of the Employment Tribunal Rules of Procedure 2013); (2) it is not in the interests of justice to give relief from the sanction of dismissal and the claim is therefore dismissed (Rule 38(2));(3) had the tribunal reached a different conclusion in relation to points one and two above, the tribunal would in any event have struck out the claimant’s claims because the claimant has failed to comply with Employment Tribunal orders; and/or because the claims are not being actively pursued (Rules 37(1)(c) and (d)).
