JUDGMENT
[1]The respondent’s application under rule 37(1)(a) of the Employment Tribunal Rules of Procedure 2013 to strike out the claimant’s claim of Direct Race Discrimination on the basis of no reasonable prospect of success, is refused.[2]The respondent’s application for a deposit order under rule 39 of the Employment Tribunal Rules of Procedure 2013 on the claimant’s allegation of Direct Race Discrimination on the basis it has little reasonable prospect of success is granted. A separate Deposit Order is issued in this respect.
