JUDGMENT

[1]The Claimant’s claim of pregnancy / maternity discrimination under s.18 Equality Act 2010 was not presented within the period of three months starting from the date of the act to which the complaint relates, but it was brought within such other period as the Tribunal concluded was just and equitable.[2]The Claimant’s claims of protected disclosure detriment and automatic unfair dismissal under s.47B, s.99 & s.103A Employment Rights Act 1996 were not presented before the end of the period of three months starting with the relevant act / omission, but were presented within such further period as the Tribunal concluded was reasonable in circumstances where it was satisfied that it was not reasonably practicable for the complaint to be presented before the end of that period of three months.[3]The Claimant’s claims were therefore brought in time and proceed.
